1. These conditions apply to all agreements with all companies, institutions and persons who have been in contact with CoolVaria.
2. All projects are carried out under the following conditions, unless expressly agreed otherwise and confirmed in writing by CoolVaria.
3. Agreements with personnel do not bind CoolVaria unless they have been confirmed in writing.
4. The client accepts the application of these conditions and warranty conditions by engaging the services of CoolVaria, in any form whatsoever.
5. If exclusions have been agreed with regard to certain subjects regulated in these conditions, the conditions and warranty conditions apply to the remainder of the agreement. Any agreed deviations only apply to the project in question, unless otherwise confirmed in writing.
Cancellations
Orders in progress can be canceled free of charge. In this case no additional costs apply. If an item has already been shipped, you can contact us about the next step.
Guarantee
New products have a minimum 24-month warranty on manufacturing defects (exception: damage due to glass breakage, rubbers, doors, hinges and locks). Demo models have a 6 or 12 month warranty.
If a product is damaged upon delivery, you may return the product within 14 days. However, you must let us know in a timely manner (within 5 days of receipt) via email, so that we can arrange a replacement as quickly as possible and report this to the carrier.
Orders are shipped with TNT Post, DPD, transport companies, etc. unless otherwise agreed.
Liability
1. CoolVaria accepts no liability for any damage, of whatever nature and of whatever origin, arising other than intent or gross negligence proven by the customer, and then only up to a maximum of the amount of the work or products delivered by CoolVaria or part thereof.
2. The customer is obliged to compensate and indemnify CoolVaria against all claims for compensation from third parties against CoolVaria for damage caused by or as a result of the delivered product.
Disputes
1. A dispute arises when a party declares that this is the case.
2. All agreements and transactions with CoolVaria are exclusively governed by Dutch law.
3. All disputes, however named, will be submitted to the judgment of the competent Dutch court, to the exclusion of all other arbitral, advisory and judicial bodies.
Final provisions
In all cases not covered by these conditions and guarantees, the decision lies solely with CoolVaria.
Handling complaints
If a problem occurs with an ordered product, we advise you to proceed as follows: you must send us an email describing the complaint and stating your billing details. The product must be delivered or shipped to CoolVaria in Utrecht. Shipping costs are borne by the customer. After the product has been repaired, it will be returned to the customer at no additional cost.
